      Can they send him on loan somewhere (or do they have to ask his permission). How much can they fine him while he is not playing? I assume that they have looked at all these things.

        Selling him at any price would cost less than sacking him. Sell him to Wembley FC.

            I think there's an agreement with the PFA which allows a maximum fine of two weeks wages.

              His wages are the problem here, many clubs would take a player like Barton based only on his football abilities but wouldn't afford his wages.

                That's why I suggested Joey should think before he tweets and accepts personal responsibility. Perhaps the club may still allow him to tweet but with the threat that if he brings the club into disrepute he will be sacked.

                  Since sacking a player is a legal act, it'll be very hard to threat him with the sack if he disreputes the club - impossible I would say. Either it is twitter, or no twitter.

                    true... although didn't man city manage to get around that somehow with tevez? it seems absurd that joseph can lose the plot, rule himself out of the most important part of his job for more-or-less 3 months and (if the rumours about his £60,000 per week wages are to be believed) pocket something in the region of £650,000 for that.

                    wouldn't surprise me if he doesn't even make the bench when he's finally available again and eventually ends up looking for first team football with another club in january (and then sues us for constructive dismissal)...

                      Agree and if the club was to do that they would then need to add it to everyones contract and get the to sign which i doubt they will do, as that can be challenged as you are restricting someone freedom of speach.

                      The only this the club can do, which they should already have in place is a company policy which applies to ALL employees players and admin staff that covers area's where they need to becareful on communcations.


                      I also like the fact that the players and the club use twitter and would not want them to change because as soon as that happens all fans will lose a great communication path to the club and staff.

                        Spot on Bigears. I work in HR and from the outset never thought their was a waterproof case to dismiss without facing some form of liability.

                        Therefore issue a FWW which makes clear without any doubt what the expected levels of conduct are, both on and off the pitch, and therefore should instances arise again in the future dismissal on the grounds of an irretrievable breakdown in trust between employer and employee can take place. Obviously such an approach can still be challenged by the individual dismissed but the employer has a solid basis to defend their action.

                        I am actually one of the few who do not want Joey dismissed as I think he offers more then he is given credit for and judging him solely on being a football player, rather then the personality, he is a player worthy of his place in the team

                          Good post Ric and totally agree with the morally bit, we can't let that come into it, because giving away that amount of money would seriously restrict us, and if this is true i think you're right, it is last chance, and i think there may be some clauses added to his contract about bad behaviour.

                            Regarding Tevez above, he effectively went on strike by going to Argentina & not returning so Man City were not obliged to pay him during that time.

                              I personally think the loss of Barton for the first half of the season will do both parties the world of good...I'm sure Barton will come back stronger as a player and a person.
