Clutching at straws there... How about about the freak gust of wind that made Barton's knee move violently towards that Aguero chappie and also managed to contort Joey's face into a vicious lookin thug whilst we're at it....

Joey Barton has been given extra time to respond to the two charges of violent conduct levelled against him for his behaviour during QPR's Barclays Premier League defeat at Manchester City.

Because of your post, we just watched it again.
First time I've really watched it that carefully, tbh.
Tevez deffo whacked Barton, silly of JB to react though.
Aguero seemed to say something to the ref that riled Barton, but, again, silly of Barton to react.
Lescott does have the flat of his hand on Barton's head, hard to tell if he actively pushes Barton's head towards Kompany, but I can see where they'e coming from.
And JB was going off the pitch quite peacefully until Balotelli stuck his oar in -- again, JB foolishly reacted to that.
Although Barton certainly didn't cover himself in glory, there were a few City players who contributed to the way his loss of self-control just escalated so quickly.
I suspect that will be the basis of any defence/appeal, but I doubt there will be any action taken against anyone except Barton.
