  • Briatore to sue FIA over F1 ban

    From the BBC website:

Former Renault team boss Flavio Briatore is to launch legal proceedings against motorsport's governing body the FIA to overturn a ban imposed on him.

The Italian was penalised for his role in Renault's attempt to fix last year's Singapore Grand Prix by asking driver Nelson Piquet Jr to crash deliberately.

The FIA has indefinitely banned Briatore from events it sanctions and forbade him from managing drivers.

Briatore said the "FIA has been used as a tool to exact vengeance on one man".

In a statement, the 59-year-old Italian described the penalty against him as a "legal absurdity", adding: "I have every confidence that the French courts will resolve the matter justly and impartially".

The FIA did not punish Renault after it decided not to contest the charges of fixing the race.

Piquet's crash led to a safety car period, which promoted his team-mate Fernando Alonso to a position from which the Spaniard was able to win the race despite starting 15th on the grid.

An internal investigation by Renault found Briatore and former engineering director Pat Symonds guilty of organising the fixing attempt.

The FIA gave Renault a ban from F1, suspended for two years, and instead decided to punish Briatore and Symonds, who has been banned from FIA-sanctioned events for five years.

Briatore's statement accused the FIA of a "deliberate breach of the rights of the defence", a "breach of the rules of natural justice" and a "manifest excess and abuse of power".

It added that: "Flavio Briatore intends to obtain an order from the court quashing the FIA's decision insofar as it relates to him, together with an order, subject to a penalty for non-compliance, requiring the Federation to withdraw any penalty imposed on him. He is also seeking damages and official publication of the court's decision."

The FIA tried to impose a similar ban on the two men at the heart of the McLaren spy scandal in 2007, only for president Max Mosley to later admit that its lawyers had advised him the ban was probably not enforceable.

I think this bad news for us!

This whole affair could turn into a circus and lead to a prelonged period of uncertainty at board room level. For example, we all hope the board are going to spend some money in January but can you really see Flavio parting with any of his cash when he is not even sure if he is going to be in charge of the club come the end of the season?

I hope this whole affair gets wrapped up as soon as possible. I would hate to see what is looking like a very promising season for us ruined by more board room turmoil!

            Correction: It will.

Nothing good about that, unless people just want to be "proved" right about their stance on Flavio Briatore, by way of months of legal battles and ill-informed opinions, based on guesswork and personal preferences.

What would be for the best is an end to all this. Closure.
            One way, or the other.

No it won't ....... the guy's been found guilty without any access to a defence, without due process, and the FIA have a terrible smell of 'set-up' about them. The (not so nice / clean / brownshirt) Mosley HATES Flavio, and he's got him removed!

Why have everyone descided that Flav's banged to rights, when he's not been given a chance to defend himself!

                Bring it on Flav!

Yes, a quick resolution which meant Flavio staying on would be preferable but unfortunately 'quick' now looks improbable. In my ideal world the Mittals would buy Briatore out, not because Briatore is necessarily guilty but because this thing getting dragged out could ultimately spell the difference in whether or not we get promoted this season. That, for me, is the reason why I would want closure sooner rather than later. Nothing personal against Flavio, its just that is what it could boil down to.

one question that nails him in my (katie) humble opinion and its thus, why did he not fight his corner straight away instead of walking?????.the thing is that could swing it for him is Moseley's replacement is a flav sympathiser

In fairness QPR Dad he did have a chance to defend himself but failed to turn up at the hearing. Think that will severely weaken any appeal. Hope for our sake he isn't banned, but have to say the odds are against him overturning this. Agree tho it cd drag on for a v long time and that this is bad news for us and poss investment etc.

I would imagin whatever flav puts in the club from now on he would get back if he has to sell, so dont c y he cant keep on investing in the club/team.
                        They seek him here.................

This wont have any implications on the club. We'll be backed in January no matter what if we a sitting pretty!

Didn't 'fail to turn up' .... didn't need to go!... Also, has not been given access to prosecution case etc. Guilt without a proper trial... typical FIA... this'll all turn out ok for FB... I bet!

I cannot understand why some are so obsessed about a ruling in another completely different sport and are still intent in mud raking despite possibly our best display on the pitch Saturday in years.

Ah perhaps thats the reason :(
